The latest ruling by the Employment Appeal Tribunal has put a lid on all these fears and upheld the rights of workers. In the case of Mr Paul Elstone, who was dismissed by Petrotechnics and then also be his next employer for whistleblowing, the EAT has upheld the claim by Elstone under Section 47b of the Employment Rights Act 1996.
It was unfortunate that BP who benefited by the whistleblowing brought the same charges against the employee to dismiss him. BP was a former client of Petrotechnics who benefited by Elstone’s whistleblowing. After Petrotechnics dismissed him, BP hired him as a consultant.
The question to be decided was whether Elstone who suffered detriment from BP could claim protection under Section 47b, because he had made a protected disclosure not to his current employer but to his previous employer, Petrotechnics and this was ultimately decide in his favour.
Elstone was represented by Anna Beale from Cloisters. Another barrister from Cloisters’, Declan O Dempsey, stated that this ruling handed down by the EAT showed support for whistleblowers. An employment lawyer has also said that the judgment would bring greater clarification and offer better protection to whistleblowers.
